1. Purpose and scope
These Terms and Conditions of Sale (hereinafter the "Terms") set out the conditions under which the association Les Cœurs-Ailés offers, organises and sells its activities, workshops and events.
They apply in particular to:
- artistic, cultural and creative workshops;
- waltz workshops and other dance activities;
- one-off workshops;
- workshop series;
- intensive courses;
- balls and evenings organised as part of the Elevalse project;
- meetings, performances and events organised by the association;
- and any other paid activity offered by Les Cœurs-Ailés.
The specific features of each activity, including its date, times, venue, content, price and any particular conditions of participation, are specified at the time of registration or booking.
These Terms are supplemented, where applicable, by the Charter for Les Cœurs-Ailés workshops and events, which sets out the principles of respect, kindness, behaviour and safety applicable to participants.
2. Registration and booking
Registration or booking for an activity may be made using the methods offered by the association.
When online ticketing is used, bookings may be made through HelloAsso.
Cash payment may also be accepted when this option is expressly offered by the association for the activity concerned.
A booking is considered final once the registration has been confirmed and, where payment is required, once payment has been made.
Any booking implies full acceptance of these Terms and, where applicable, of the Charter for Les Cœurs-Ailés workshops and events.
When the number of places is limited, registrations are accepted within the limit of available places.
3. Prices and payment terms
Prices are stated in euros and correspond to the prices applicable at the time of registration.
Les Cœurs-Ailés reserve the right to change their prices for future registrations. Any price change has no effect on bookings already confirmed.
Payment may be made:
- through the HelloAsso ticketing platform, when it is used;
- in cash, when this payment method is offered by the association for the activity concerned;
- or by any other means of payment indicated at registration.
4. Right of withdrawal
When registration is made remotely, in particular online, the rules on the right of withdrawal set out in the French Consumer Code apply where required by law.
However, certain services are exempt from the right of withdrawal, in particular leisure services to be provided on a specific date or during a specific period.
The applicable conditions may therefore vary depending on the nature of the activity booked.
5. Cancellation and refund conditions
Cancellation and refund conditions depend on the nature of the activity.
5.1. Balls and evenings on a fixed date
Tickets for a ball, an evening or an event on a fixed date, in particular the Elevalse Ball Evenings, are final and non-refundable once the booking has been confirmed, unless otherwise required by law or if the event is cancelled by the association.
The participant's absence, for whatever reason, does not give rise to a refund.
Unless otherwise indicated by the association, a ticket cannot be transferred to another date.
5.2. One-off workshops
Registrations for one-off workshops are non-refundable once the registration has been confirmed.
However, when organisational conditions allow, the association may offer to transfer the participation to another date or to another equivalent workshop.
Transfers are not automatic and must be requested from the association before the date of the workshop concerned.
The association reserves the right to refuse a transfer request when organisational constraints or the number of available places do not allow it.
5.3. Workshop series
Registrations for a workshop series are final and non-refundable once the registration has been confirmed.
The participant's absence from one or more sessions does not give rise to any refund, reduction or compensation, unless otherwise specified at registration.
Any arrangements for replacing or rescheduling a session decided by the association will be communicated to the participants concerned.
6. Cancellation or modification by the association
Les Cœurs-Ailés may exceptionally need to change the times, venue, content or arrangements of an activity for reasons beyond their control, in particular in the event of problems with the premises, force majeure, exceptional circumstances or safety requirements.
The association undertakes to inform the participants concerned as soon as possible.
If an activity is permanently cancelled by the association, the participants concerned will be informed of the arrangements offered.
Depending on the nature of the activity and the circumstances, the association may in particular offer:
- a postponement to a later date;
- participation in an equivalent activity;
- or a refund of the amounts actually paid for the cancelled activity.
7. Access to activities and behaviour
Taking part in Les Cœurs-Ailés activities implies compliance with the operating rules, the safety instructions and the Charter for Les Cœurs-Ailés workshops and events.
Each participant undertakes in particular to behave respectfully and kindly towards other participants, instructors, volunteers, artists and organisers.
Any violent, discriminatory, harassing or dangerous behaviour, or behaviour clearly incompatible with the smooth running of the activity, may lead to exclusion.
Where exclusion is made necessary by the participant's behaviour, no refund may be claimed as a result of that exclusion, subject to applicable legal provisions.
8. Clothing and equipment
Participants undertake to follow any recommendations regarding the clothing and equipment required for the activity.
For dance activities, comfortable clothing allowing sufficient freedom of movement is recommended.
For waltz practice, in particular as part of Elevalse, it is preferable to wear closed-toe shoes in order to protect the feet and limit the risk of injury in the event of contact or collision.
When personal equipment is required, the participant remains responsible for it.
9. Liability and safety
Each participant is responsible for their own safety and undertakes to follow the instructions given by instructors and organisers.
Participants must take into account their abilities and any physical limitations, and report any situation likely to present a risk to themselves or others.
Les Cœurs-Ailés cannot be held responsible for the consequences of failure to follow safety instructions or of inappropriate behaviour by the participant.
The association cannot be held responsible for the loss, theft or damage of personal belongings brought by participants, except where it bears legal liability.
In the event of an incident or accident, the association may take the necessary measures to ensure the safety of the person concerned and, if necessary, contact the relevant emergency services.
10. Respect for premises and equipment
Participants undertake to respect the premises, equipment, facilities and materials made available to them.
Any damage resulting from wrongful or deliberately inappropriate behaviour may engage the liability of the person responsible under the conditions provided by law.
11. Image rights
During the workshops, balls, evenings and events organised by Les Cœurs-Ailés, photographs, videos or other recordings may be made in order to keep memories of the activities, document them and contribute to their communication, promotion and showcasing.
Taking part in an activity or event organised by Les Cœurs-Ailés implies acceptance of possibly appearing in photographs or videos taken in this context, and authorisation for the association to use and reproduce, free of charge, the image of participants thus captured.
This authorisation is granted without time limit and for all activities and events organised by Les Cœurs-Ailés, present and future, in particular as part of the Elevalse project.
Images may be used on the association's various communication media, in particular:
- the website;
- social networks;
- posters and flyers;
- programmes and printed materials;
- newsletters;
- audiovisual media;
- files or communications intended to promote the association's activities;
- and any other communication medium used to present, document or showcase the activities of Les Cœurs-Ailés and Elevalse.
This authorisation is granted free of charge, for the purposes of communication, promotion, documentation and showcasing of the association's activities.
Les Cœurs-Ailés undertake not to use a person's image in a context likely to harm their dignity, privacy or reputation.
Unless specifically agreed, images will not be used for commercial purposes unrelated to the association's activities.
Anyone who does not wish to be photographed or filmed is invited to contact the organising team before or at the start of the activity. The association will endeavour, as far as possible, to respect this request and avoid any identifiable use of their image.
12. Personal data
Personal data collected during registration is used in particular to:
- manage registrations and bookings;
- organise workshops and events;
- communicate with participants;
- handle the administrative and accounting follow-up of activities;
- and, where the participant has consented, send them information about the association's activities.
Personal data is processed in accordance with applicable regulations.
The persons concerned have the rights provided by applicable data protection regulations.
For any question regarding personal data, participants may contact the association at: lescoeursailes@gmail.com.
13. Complaints
Any complaint concerning a registration, a booking or the running of an activity should first be sent to Les Cœurs-Ailés at: lescoeursailes@gmail.com.
The association will endeavour to find an amicable solution to any difficulty encountered.
14. Consumer mediation
Where consumer mediation regulations apply to the relationship between the association and the participant, the participant may, after first submitting a complaint to the association and in the absence of an amicable resolution, refer the matter free of charge to the consumer mediator to which the association belongs, under the conditions provided by the regulations.
15. Force majeure
Les Cœurs-Ailés cannot be held responsible for failure or delay in performing their obligations when this results from an event of force majeure or circumstances reasonably beyond their control.
In such a situation, the association will inform the participants concerned as soon as possible and will determine, depending on the circumstances, the arrangements for postponing, modifying or cancelling the activity.
16. Changes to the Terms
Les Cœurs-Ailés may amend these Terms to reflect changes in their activities, their operations or applicable regulations.
The applicable Terms are those accepted by the participant at the time of registration or booking.
17. Acceptance of the Terms
Any registration or booking for an activity offered by Les Cœurs-Ailés implies that these Terms and Conditions of Sale have been read and accepted.
When the booking is made online, the participant acknowledges having been able to read these Terms before confirming their registration or purchase.
Acceptance of the Terms also implies acceptance of any specific conditions relating to the activity booked.
